Because trials involve risk, taking a dispute to court is not always in a client's best interest. At the Law Office of David H. Pollack, LLC, we help our clients resolve conflicts not only through litigation, but through other methods of alternative dispute resolution such as negotiation, mediation and arbitration. These methods of resolution can avoid the uncertainty and expense associated with a trial.
Certified by the Florida Supreme Court as a Circuit Civil and Family Mediator, David H. Pollack knows how to build consensus and resolve issues outside of a courtroom.
Formerly a mediator with the Center for Conflict Resolution and ATD Mediation, Mr. Pollack uses his knowledge as a litigator and appellate attorney to help opposing parties evaluate their settlement options and assess their risks.
In-House Mediations
Mr. Pollack has been approved as a mediator by the Florida Department of Financial Services and the United States Postal Service, where he has mediated in-house disputes between employees and management. He also serves on the City of Coral Gables' Trial Board, a five member panel that adjudicates employee grievances.

What Is Mediation?
Mediation is a client-centered alternative dispute resolution technique in which the opposing parties, with the help of their attorneys, work with an independent, neutral, third-party mediator to decide whether and how to settle a dispute. The mediator does not decide the case, but helps clarify the issues and assists the parties in working toward an agreement. Not only is mediation more cost effective than courtroom litigation, it also gives the parties involved more input into, and control over, the eventual decision. If a dispute cannot be resolved in mediation, either party can decide to take the case to court.
What Is Arbitration?
Arbitration is frequently the next step in the alternative dispute resolution process. Disputing parties and their attorneys present their case to an arbitrator or a panel of arbitrators who decide the issue. Arbitration can be binding or non-binding. Parties to a binding arbitration agree in advance to accept the decision of the arbitrators and not to pursue further litigation. Taking a case to trial remains an option in non-binding arbitration.
